The right to intellectual property and the quagmire of patent trolling in East Texas

george washington carverThe history of patents in the USA is synominis with names like Thomas Edison, George Washington Carver, Albert Einstein, and Bill Gates. Because with each invention and innovation that was thought up of, there was the need for a patent.

Among the many things that factored into becoming the great nation we are is innovation. We have throughout our history found a way to keep speeding ahead with new technology that bettered the lives of Americans and others across the globe.

And in this modern age we continue to look for that “next step” that would continue to elevate us to the next level. Yet, there is one, minor, practice that has both the potential to hinder innovation and leave a scar in our history.

The term, “patent troll” refers to a company that buys and uses patents for the sole purpose of bringing other businesses to court for patent infringement. Besides the unethical method of “business” they are using to gain wealth, is that this type of practice hinders innovation.

The institution of patents and licensing in our nation follows some of our basic principles and beliefs that each man has a right to his property. We can think of patents as the holding of one’s “intellectual” property.

And with a patent an individual has the freedom to pursue their invention with the peace of knowing that it is protected from theft. But, what’s more, is that this encourages the creation of technology. What we find with these patent trolls is an abuse of the system.

As they utilize they protection of held patents to earn royalties and compensation, they sit back with their profit without any purpose or plan to follow through to create or build their invention. That’s right, not only do they not make the patent into a realization, but they punish other businesses that have.

When we observe the things that have come out of the excellence of work of some men in history, it is so sad to see what some individuals are doing to hinder that from going on.

Cystic Fibrosis Foundation

Cystic Fibrosis FoundationCystic Fibrosis is a life-threatening disease that starts at birth. The child can get it if both parents are carriers of defective CF gene. Mucus builds up in the lungs and organs or a person with Cystic Fibrosis and this causes their organs and lungs to shut down and many people have to get transplants; but even transplants will not heal Cystic Fibrosis because Cystic Fibrosis dwells in the cells. Over 30,000 children and adults in the United States alone has been diagnosed with CF. There is no known cure for Cystic Fibrosis for the time being. There are many diets, therapies, and hospital care that can help with people live with this disease. Many people have passed away very young due to this disease. A young girl who grew up in Tyler just recently passed away after having a lung transplant that her body rejected. She was diagnosed with Cystic Fibrosis as a toddler, and had to live a large amount of her life in hospitals and clinics. She was only 23 when she passed away. She lived with Cystic Fibrosis and knew the dangers and reality of the disease but she celebrated and made the most of the life that she was given to live.

Cystic Fibrosis is closer than we know. There are many things we can do to help with the research of Cystic Fibrosis. In 1955 The Cystic Fibrosis Foundation was founded. At that time children with CF were not expected to live longer than a few years old. The study of this disease has come a long way but they still have not found a cure and many people are passing away due to this disease. The Cystic Fibrosis Foundation is a non-profit organization that supports scientists and doctors that are searching for a cure. They run on support and donations. There have been many different businesses in Tyler that has raised money for this foundation. McAlister’s Deli, Double Dave’s Pizza, and many other places have had events to raise money to support the search of CF. the CF foundation has an annual walk at different locations in East Texas. The next event coming to East Texas is at the new BJ’s restaurant. They are opening their doors to many different invited guests to eat from their special complimentary menu, but ask that everyone that eats there gives a donation to the Cystic Fibrosis Foundation.

These events are a great way to reach out to our community and the many people that are suffering or have lost loved one due to this disease. You can be a part of something great! Tuesday Morning Store in Tyler Offers Excellent Christmas Gift Selection

Tuesday Morning Stores TexasFor those like me that may have never heard of Tuesday Morning before it isn’t a big surprise. This store seems to open up when they want to and probably just during those certain shopping days that bring in lots of traffic. So they aren’t like Marshall’s where they are open every day.

I guess Tuesday Morning has a low overhead policy but it must work as I have seen their sign over by Cotton Patch Cafe for several years.

This store always looked closed and abandoned but one Sunday morning we were nearby and I yanked at the door and to my surprise the door opened and there were tons of Christmas gift ideas almost everywhere I looked.

I also found some pretty ridiculous white elephant type gifts to get as well. This store is like a cheaper Marshall’s but with more selection and variety. They aren’t necessarily like Marshall’s in the sense of having lots of clothes but they are like them in their never ending supply of odds and ends.

For instance, last year I was able to purchase from Marshall’s an alarm that would sound if a dog jumped and laid down on a couch or chair in your house. I saw this as both funny and useful for certain people in my family.

Tuesday Morning store has all kinds of weird stuff like this and good stuff too. They have toys, rugs, clothes, sheets, towels, furniture type items, Christmas decorations like big Santa statues and many things you would never buy but they are fun to look at.

I bought a few fun to look at items that will be white elephant gifts this year. So if you are reading this maybe you haven’t come up with any Christmas 2010 gift ideas and maybe your a procrastinator.

Tuesday Morning can come to your rescue and relieve your stress because they have everything for mom, dad, kid, toddler, sister, brother, emo brother, brother in jail, grandmother, granddad, and wife, and husband, I guess cousin too.
