Politics and patent infringement cases in East Texas, what is the connection?

patent litigation law firms and politicsYes, politics do play a part. Well, at least when it comes to patent infringement cases, it seems that it has. An interesting report has gone out where it ranks court districts under certain categories in patent litigation.

The eastern court district of Texas has a strong reputation for being the forum of choice for patent infringement cases, yet surprisingly enough it does not rank first in any of the important categories.

The western district of Wisconsin ranks first when it comes how much time it takes to process a litigation cases with a little over six months, yet they are often overlooked as a forum for the infringement cases.

This has given them quite the chip-on-the-shoulder. So the question begs to be asked, what makes the eastern Texas district more appealing? There is a separation between these two states that is more than six Midwest states and that separation is political worldview.

It is safe to say that the majority of Texas leans conservative and the majority of Wisconsin leans liberal. Taking what we know about the two views, we know that conservative Texans are big on property rights, whether it’s physical or intellectual property.

Now, it’s not to say that the people of Wisconsin don’t feel the same, but when it comes to the whole issue of “what is mine, is mine” there ain’t no place like Texas.

And when it comes to plaintiffs picking there “forum” of choice, the one category that overrules them all is the amount of victories in a district. And where East Texas ranks 7th with a 40 percent win rate, Western Wisconsin ranks 28th with a 24 percent win rate.

There are many factors that can play into why there is such a gap in percentage, but you can bet that part of it is the difference in political views.

Choosing an East Texas Court Forum

court forum patent trollThe Discovery Channels popular program “Myth busters” pride themselves on discovering whether or not a presupposition is correct. Well, I have a myth that needs some busting.

Is the eastern court district of Texas the best forum for patent infringement cases? Patent litigation has become more than protecting your intellectual property rights, it has become a form of business for some.

There is a genre of companies who carry the “patent troll” label based on the unethical business of obtaining patents from other businesses or firms in order to use them to collect financial rewards in patent infringement lawsuits.

Whether it’s one of these “patent troll” cases or your normal run-of-the-mill case, the plaintiff has the right to choose what “forum” or court location the case is brought to.

And throughout the patent litigation world, East Texas has become the place to go. But the question is, are the reasons why myth or reality? It has been explained that the major factors for East Texas becoming the location of choice is due to rocket docket (fast processing of patent infringement cases) and percentage of plaintiff victories.

But the truth is, in a recent investigation of patent litigation cases throughout the United States, the eastern district of Texas does not even rank in the top 5 of either one of those categories.

When it comes to “rocket docket” East Texas ranks in the bottom half and in victory percentage for plaintiffs it ranks 7th place. So is East Texas the ideal forum for patent infringement lawsuits?

When it comes to technical ranking, no it is not the best. But, just like the aging star athlete, reputation and experience can matter more, and I think that is what still makes East Texas the most popular forum.

Experiencing Life Outside of Tyler Texas

Travel companies in Tyler Texas have offered me very little in helping me find good travel destinations, airline tickets, and arrangements.

A travel agency is a good thing and of course we want to help out local companies in Tyler but when they don’t deliver in customer service and act super snobby you can’t really blame me for planning my trips on my own. I gave my travel agency several chances but things only got worse.

Getting beyond the local travel agency issues you can easily step outside your protected environment in Tyler and experience life a little different when visiting a foreign country.

Keep in mind that although traveling around the world is fun it really isn’t what experiencing life is all about.

Some of my favorite places I have been in the world are Belize, and Florida. I have been to Europe and have seen and experienced it but I began to see just how amazing we have things over here in our little corner of the world.

Meeting people and visiting new places in different countries is fun and different and I recommend doing it if you can afford it. What I have circled back around to is how much more the US has to offer in regards to fun, interesting new sites and people to meet and see.

I get my airline tickets and travel packages on Priceline and other similar online travel sites. I recommend trying your local travel agency in Tyler but if they give you that fake grin without listening just shop for yourself on Priceline.

Finally I just want to say that no matter how many places and people you meet in the world there is no better way to live life and experience life than to make an impact in those peoples lives you have to maintain a reputation around because you are not some anonymous person just passing through but an active member of your local community in Tyler Texas.

On South Broadway and Rice in Tyler, TX there rests a Starbucks. I love Starbucks. I’m not really sure why, but I do, I follow suit with most everyone else. And usually everyone is nice and inviting. No problems, easy come and go visit. But there was one occasion this past Halloween that didn’t meet my expectations. My friends and I had decided to dress up as the 12 disciples and Jesus and pose as the Last Supper painting that Da Vinci painted. We had a table, a huge picture frame and all were dressed for the part. It was quite wonderful and everyone thought it was great. WE have a reputation for doing things lavishly.

The year before we had dressed up as Noah’s Ark. 22 people, just as many different animals and HUGE cardboard Ark, painted and cut out. We had made up a song and everything. The year before that we were the nativity scene. Anyways… So here we are as The Last Supper. I guess the weekend before that part of out group had been at this Starbucks doing a pumpkin carving contest and everyone was dressed in costume. It was quite wonderful and fun. So these same friends thought it would be great to visit them again in our group costume.

Well… we drove up, got out of our cars, I must admit this might have looked scary with three cars pulling up and 14 Jesus looking people with boxes (our table) and a huge picture frame walking toward the door. But as we approached someone from the store met us at the door and told us we couldn’t come in, that we couldn’t bring boxes into the building. We were so confused because it was so random and they had just had a huge costume party basically so what was different about today? She kept saying it was company policy, no boxes could be brought in. All we could do was turn around and leave, we were so confused.

Well there is another Starbucks location on the way home and we had already told our friends working there that we would come in to show them our costume. So we headed over there. We went in, planted our selves in front of the registers and sang our song and everyone clapped and cheered. They loved it, customers and all. We asked them if there was such a rule as the other store so adamantly proclaimed but they had no idea about it, so we laughed it off.

I must say that every time I’ve been in the first location since I’ve had a guilty a conscience. I haven’t even done anything wrong, but I feel like they will make up another excuse to kick me out or something. Even though I know that isn’t true. The second Starbucks remains my favorite, they are the most easy going.

Unfortunately next year I’m not going to be living here anymore and I won’t be able to be in another group costume. I’m a bit sad about that. But I can’t wait to see the pictures! We rock Tyler.

Owner Kenny Giles keeps a busy stream of customers going and coming and the guys at Grace have an excellent reputation as honest businessmen as well. They won’t recommend unnecessary labor, and they are willing to work with customers to keep the parts costs low. As a result their over all prices are quite reasonable. Mr. Giles also keeps a number of repaired vehicles in the yard, which he sells at low prices to those in ministry who are in need of transportation.

Their Christian ethics, and ties to individuals in local Tyler Texas ministries has afforded them with many opportunities to be a blessing to area charities. All this goes to establishing an excellent reputation in the community. Honest repairmen can be difficult to come by, but if you’re looking for auto work, at a reasonable price, Grace Auto Works is a trustworthy local business everyone should know about.
